Some came with the smf software.

The ones we added came from a free site.

I'd like to add this one, but the site it's hosted on doesn't give any info on re-use, only if it's copyrighted you have to own it to upload it to that site. I haven't seen this one on any of the 'free' sites.

Would "fair use" be applicable since this is not a for profit venture? I'd IMAGINE that since no profits are made, the owners (if there are any) would just say "take it down."

No, I dont know who owns it  Someone used it on a Moto Guzzi forum. That is where I saw it for the first time.  The person who used it doesn't know anything more about it's origins than we do.

IMO...linking to it is very different than adding it to our server.

If someone wants to contact the host site and ask what the restrictions are, if any, about copying the image and adding it to another server go for it. If they say it's free for that use I'll add it.

fair use is a defense.  which means you have to get sued first to claim it.

some types of not-for-profit limited use automatically qualifies such as a teacher using excerpts from a book.

but using an animated icon in total, which might or might not be copyrighted?  Not sure.  it's clearly not a trademark since it does not identify the trade/service it refers too -- merely making the throttle action is too general.

using it probably would result in no hassles.  in order to be sued and for them to get damages, the user has to have had some kind of notice it was copyrighted, whether actual or constructive. 

if after a diligent search there is no indication of even where the icon was made or came from, then it's easy to reply to a demand to remove it and pay damages that there was no notice of a copyright, either actual or constructive.

one may also search the USPTO'S mark database.
