Title: HELP!!! I bought a bike and it ended up being stolen...

I bought an '05 R6 "stunt bike" from a guy off the ATL Craigslist.  My friend had already bought a fairing for his R6 off the guy a week earlier and said he had a whole bike, so........like an idiot I sent my buddy the $2,800 to get the bike with and the guy delivered it to my friends house in Kennesaw, GA.  My friend works for the city and was going to get a bonded title on the bike and then transfer it over to me since I can't title the bike in TN the same way.  Anyways, the guy includes the bill of sale with a copy of his GA State ID on it, his pic and his real info on that as well.  The next day my buddy gets the police to come over and run the VIN so they can start the paper work and it came up stolen out of Jacksonville, FL.  They towed it on the spot.  Well good for them finding a stolen bike, but I'm left -$2,800 and they aren't doing anything about it.  I'm going to drive a 9 hour round trip tomorrow to file a civil suit against the guy, but as most of you know, that's about worthless.

We contacted him about making it right since my buddy would swear the guy didn't know it was a hot bike.......why else would your pic be included right?  He was going to get my money back to me, but then he fell off the radar..........go figure.  Any info on this guy or his where-a-bouts would be greatly appreciated.

Sorry for the novel, but he's been trying to sell off a bunch of other bike stuff, I wouldn't be surprised if they're stolen too.

and many people wonder why I always spend the extra money to buy new vehicles or through a dealer rather through a private seller and especially trust those on Craigslist or Ebay.

People should take the VIN of used vehicles they want to purchase and get a DMV history on it.

If you have  signed documents that this Mr Glover guy received your $2,800 in exchange for the bike which was stolen then this should be a case enough to have authorities hunt Mr Glover down as the possible suspect in theft of the bike.
If he has made himself unavailable to contact and has not returned the money, that amount of money taken is a felony next to the fact that he may of actually known it was stolen or even stolen it himself.

I do have that paper showing that he received $2,800 for the bike, the VIN is listed on it and there is a copy of his ID on it as well.

I'm assuming you've been in contact with the authorities....

Yes, and they've done nothing.........they basically took all the info and sent it to Jacksonville, FL.......the police down there have yet to contact anyone.  I'm assuming they'd put out a warrant for the guys arrest, but we're in the dark.

Very much so.  Our legal system is VERY inadequate.  I received counterfeit postal money orders for my old Explorer when I was in Charleston and they wouldn't do anything about it........I ended up locating the truck by myself, shooting spy photos, and getting all the paperwork in order and FINALLY a police officer was willing to do something to prevent me from just confronting the person by myself. >:(

Well, I found out my "buddy" down there would have to do all the leg work since the bill of sale was in his name...........pretty sure he's done nothing.  That dude is out enjoying my money and I don't have a pot to sh*t in......sucks, I hate the legal system..........so full of defects that protects criminals.  Even if I was able to file a civil suit against him, they'd have to find him to serve him [bang]

sorry man.. I guess that you would have to do what you did for your Explorer and get justice on your own.. or just forget about it ..  At least for your future transactions you will be extra cautious.  You can't trust anyone these days.

Have you looked into the silly television courts? They can award damages of up to $3-5k and often award "litigants" an appearance fee of the same. In short, the guy CLAIMING to not know the bike was stolen could make right and you could get the appearance fee + a refund of your cash. The other guy would lose a little time and look like a douche on tv.

generally, finding people that aren't trying to hide isn't difficult at all. just hire the right people (p.i. or process servers)

craiglist is normally very good, you just have to get a clean title from someone with their name that matches their id, etc.  no title, no sale, simple as that in my book.  bill of sale as you are fiinding out is basically worthless.

now title is not always 100% full proof and those can be counterfeit as well but its something else someone has to forge which is sometimes harder to do.

its not the legal system that fails you, its the people that have to go out and try to stop criminals that are failing you, sounds like they are not doing anything like you said.

I pushed buttons in GA and got a felony warrant issued for his arrest........but now they need to actually find him or that does nothing either............maybe one day I'll get it back.  (not holding my breath)

His address isn't accurate any more, but I have his real name etc.  Not sure of the legal stuff associated with any of what you mentioned though.  I'm guessing he owns nothing though.......

How much are you in for?  Sue him in small claims, you have more thab enough evidence.  Take the judgement and mail copies to all the banks around and all the national and internet banks.  They are obligated to freeze his account if they get a copy of an order and an account matches.  He'll pay.

Look up to see if "service by publication" is available in your county for small claims.  if it is, you just have to show the judge you did it.  Easiest way to get a judgment, when the bastard doesn't even show up.

I live a state away in TN.  I'll have to contact the courts down there and do a little research though, that would be nice to go ahead and have the ruling for when they arrest him. [leo]

I would be surprised if the court didn't allow service by publication.  Usually it requires you to mail to the last known address, get a kick-back (send it certified with signature, and have it rejected..) then you get to put an ad in a paper.  There is a fairly standard format for it.

Once you do that and it runs for the statutory time, you take all your papers (rejected letter, copy of the ad, and all your evidence) and you go file.  Judge will look at you, look at your evidence, and ask the court if anyone comes to stand for the defendant -- no answer?  you get a default judgment.   I helped another guy on TOB to do this exact thing when someone ran over his bike and he couldn't get the cops to arrest the guy (no proof he was driving his own car -- witnesses told the police the car's tag, etc).. He froze the guy's accounts, and he couldn't pay rent -- he coughed up the money fast.

Once you get your money, you simply tell the cops where he sent it from.

Hire a PI, it'll run around 200.00 to get him properly found and served.. I know a few private investigators who are in California and find these kinda jerks all the time..

This is what you would call a mystery bag of shit.  Law enforcement doesn't like to go near stuff like this.  Were you able to file a formal complaint in the county/town of occurrence/transaction?  It sounds like this dirtbag is in the wind.  I'd hate to be the harbinger of doom but you might have to chalk this up to a lesson learned.  I shouldn't have to say what the lesson is here. 
The local authorities probably wont spend too much time on this.  Especially when the place of occurrence and the complainant(you) are not even in the same state.  Like someone else here said, you and your friend should see if this guy is still peddling his stolen loot on craigs list and set up a sting.  Maybe you and your buddy can dish out your own brand of justice. [evil]

I was able to push buttons down there and they realized NOTHING had been done what-so-ever since the impound.  I finally was able to get a felony warrant out on the guy, but now we're "waiting" for him to get caught.........then the slow process that will hopefully bring some of it back.  I'm sure I'll never see a penny, but at least if he gets popped he has a felony conviction  [beer]

It's sad because it's true.........the legal system in this country protects criminals.  Too bad I have morals, I could be rich at everyone's expense........ [thumbsdown]

if he's ever in the state and gets pulled over, you can bet they will give him the royal treatment.

The DA's will plea it down to a traffic ticket.

Nothing from the Kennesaw Police since the warrant was issued for the guy.  Just waiting for him to mess up and get picked up.

Well I chalked it up to our failed legal system and an almost $3k learning experience......I'd love 5 minutes alone with the guy and my baseball bat.........but that's just me [beer]

Have you sued him?

If you sue him, you can notice him by publication.  You don't need to have an arrest/conviction to prevail.

Even if he doesn't show up and you get a judgment, you send that judgment to every bank in the state and they will freeze his accounts until he repays you.
